Do you need a lawyer for family court?

While not a legal requirement, we strongly recommend seeking the support of an experienced family law solicitor for your case if it is feasibly possible.

Is mediation compulsory in Family Law?

Usually, you will need to undergo mandatory family mediation, referred to as Family Dispute Resolution (FDR), before applying for Parenting Orders. However, mediation is not compulsory in all Family Law matters. For example, if your property settlement is straightforward, your family law solicitor may be able to reach a resolution through direct negotiation with the other party’s lawyer.

However, we recommend considering mediation if you wish to settle your family matter as soon as possible without the hassle or cost of going to Court.

Is there a time limit for property settlement after divorce?

While there is no time limit in which an application for divorce must be submitted, there are specified periods in which you must apply for property settlement depending on your relationship:

  • Property settlement where the couple is/was married: an application for property settlement or spousal maintenance to the Court must be made within 12 months from the official date of divorce.
  • Property settlement where the couple were in a de facto relationship: an application for property settlement or spousal maintenance to the Court must be made within 2 years from the date of separation.
